Terms and conditions of sale

This is an English translation provided for convenience. The French version is the binding text. Consumers resident outside Switzerland may hold additional mandatory rights under the law of their country of residence, which are unaffected by these terms.

ARTICLE 1: SCOPE

These terms and conditions of sale apply to all sales concluded through the website https://esprit-boxe.com/

ARTICLE 2: ORDERS

Automatic recording systems are considered to constitute proof of the nature and content of an order. Esprit Boxe® confirms acceptance of an order to the customer at the email address they have provided. The sale is concluded once Esprit Boxe® validates payment of the order, meaning the date payment is validated for orders paid online by card, or the date payment is received for orders paid by cheque.

Esprit Boxe® reserves the right in any event to refuse or cancel an order from a customer with whom a dispute exists over payment of a previous order.

ARTICLE 3: AVAILABILITY OF ITEMS

Our offers and their prices are valid for as long as they are shown on the site. The availability indicated when the customer views the site remains subject to stock held by Esprit Boxe® and by its suppliers.

Our shop window and sales catalogue are built from databases enriched with the information supplied to us. That database contains more than 1,400 items, not all of which are held in our own stock, so our offer is conditional on availability at our suppliers. Only a permanent discontinuation at our suppliers leads to an item being withdrawn from sale. In other cases, a new order remains possible after a certain delay.

Where an ordered product is unavailable, the customer is informed by email, or on the invoice of the products dispatched in the case of a multi-item order.

Delivery deadline: a delivery time is given to the customer when the order is placed and on the order acknowledgement. It is calculated by adding the longest product availability time to the transit time of the shipping method selected. From the moment the order is placed until it is dispatched, the customer may cancel it.

Pre-orders: forthcoming products are offered on the site as pre-orders, with the availability date announced by the manufacturer at the time the reservation period opens. That date may be changed at any time by the manufacturer, who is solely responsible for bringing the product to market. In all cases Esprit Boxe® endeavours, from the definitive release date, to dispatch items to customers who have reserved, to the extent of the stock supplied by the manufacturer for the availability day.

ARTICLE 4: PRICES

Prices shown are net. The price includes the price of the products and the costs of handling, packaging and storage. Prices may be changed at any time without notice, it being understood that items are invoiced on the basis in force when the order is recorded.

Orders are invoiced and payable in the currency displayed at the point the basket is validated, according to the delivery country: euro, pound sterling, US dollar, Canadian dollar or Australian dollar. Any customs duties or local taxes remain payable by the recipient.

ARTICLE 5: PAYMENT

Several payment methods are available, each offering the maximum security guarantees. You may pay by bank or private card (Visa, Eurocard/Mastercard) directly on the site, through the payment form offered during the order process, with entry secured by SSL encryption, giving the card type, the card number without spaces, the security number on the back of the card and the expiry date.

Payment is processed on the secure banking servers of our partners. This means that no banking information concerning you passes through the site https://esprit-boxe.com/. Payment by card is therefore fully secure; your order is recorded and validated as soon as the bank accepts payment.

ARTICLE 6: DELIVERY

We deliver to your home or to a pick-up point. The delivery time comprises the time to prepare the parcel plus the transit time. Esprit Boxe® delivers worldwide.

The buyer is notified by email at each stage of the order: preparation and delivery. The delivery time quoted when the order is placed applies from the moment the buyer receives the dispatch email. A delivery time announced by the carrier does not bind Esprit Boxe® to any longer period.

ARTICLE 7: WARRANTY — RETURNS — REFUNDS — RIGHT OF WITHDRAWAL

Items supplied by https://esprit-boxe.com/ are new and guaranteed against any defect. They are identical to those sold in traditional retail and come from the full range of listed brands and suppliers.

Should an item be defective or not as described, the buyer has 30 working days from receipt of the items to request an exchange or a refund. If the thirty (30) day period would normally expire on a Saturday, a Sunday or a public holiday, it is extended to the next working day.

The customer must return the items new or unused, complete and in their original packaging, intact, together with any accessories, instruction leaflets and documentation, in the original sealed packaging and with the corresponding invoice.

In such a case, the buyer must send evidence of the defect or defects to info@esprit-boxe.com, with a description and photographs attached.

Where the right of withdrawal is exercised, Esprit Boxe® is required to refund the sums paid by the customer, at no charge other than return costs. The refund is due within a maximum of 14 working days from the date the returned parcel or parcels are received. Return shipping costs then remain payable by you.

No cash-on-delivery shipment will be accepted, for any reason.

ARTICLE 8: TRANSFER OF OWNERSHIP — TRANSFER OF RISK

Ownership of the products passes to the buyer only once the price has been paid in full, whatever the delivery date of those products. The risk of loss and damage, by contrast, passes on delivery and receipt of the products by the buyer.

ARTICLE 9: PROTECTION OF YOUR PERSONAL DATA

Esprit Boxe® is the producer and owner of all or part of the databases making up this site. In accessing the site, the customer acknowledges that the data it contains is legally protected, and undertakes in particular not to extract, reuse, store, reproduce, display or retain, directly or indirectly, on any medium, by any means and in any form, all or a qualitatively or quantitatively substantial part of the content of the databases on the site.

ARTICLE 10: LIABILITY

Product descriptions in the databases of https://esprit-boxe.com/ have been entered from the information supplied by manufacturers and suppliers. Esprit Boxe® cannot be held liable towards the buyer for an inaccuracy appearing in supplier documentation.

Esprit Boxe® cannot be held liable in the event of force majeure (strike, flood, fire and similar events). The products offered comply with Swiss and European legislation in force. Esprit Boxe® declines all liability if a delivered item does not comply with the regulations of the country of delivery (import restrictions, local standards applicable to sports equipment). Esprit Boxe® is not responsible for the content of sites to which hyperlinks from its own site may lead.

ARTICLE 11: GOVERNING LAW

All the clauses in these terms and conditions of sale, and all the purchase and sale operations they cover, are subject to Swiss law. This clause does not deprive the consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

ARTICLE 12: ACCEPTANCE BY THE BUYER

These terms and conditions of sale and the prices are expressly agreed and accepted by the buyer, who declares and acknowledges having full knowledge of them and therefore waives the right to rely on any contradictory document, in particular their own general conditions of purchase, the act of purchase entailing acceptance of these terms and conditions of sale.
